According to the State of New York’s Division of Criminal Justice Services “Unlicensed operation of a motor vehicle” (Vehicle %26amp; Traffic Law § 509.1) and “Aggravated unlicensed operation of a motor vehicle in the third degree” (Vehicle %26amp; Traffic Law § 511.1A) are both deemed misdemeanors in the State of New York.

509.1 is a lesser offense to 511.1(a)

“Defendants who drive without a license but do not know (or have reason to know) that their driving privileges have been terminated commit a misdemeanor (Vehicle %26amp; Traffic Law § 509 [1]).”
